CHAPTER 7: THE CUSTODY BATTLE

The courthouse felt colder than the hospital had.
Megan sat quietly outside Courtroom 4B, her hands folded in her lap.
Across the hallway, Lily colored a picture beside Claire, carefully filling in the roof of a small house with a red crayon.
There were only two people in the drawing.
A mother.
And a little girl.
No father.
Megan looked away before the tears could come.
Rebecca Lawson emerged from the courtroom carrying a thick stack of files.
"They're ready for us."
Megan stood.
"How do I look?"
Rebecca smiled gently.
"Like a mother who's been protecting her child."
"That's enough."
Brian was already seated when they entered.
He looked exhausted.
The dark circles beneath his eyes had become impossible to hide.
He hadn't shaved in days.
For the first time since Megan had met him eight years earlier, he looked older than his age.
Donna sat directly behind him.
Despite everything that had happened, she still carried herself with absolute confidence.
She whispered into Brian's ear.
"Remember."
"You love your daughter."
"You deserve equal custody."
Brian nodded silently.
But his eyes never left the empty chair where Lily would have been sitting if children were allowed inside.
Judge Katherine Ellis entered.
Everyone stood.
After reviewing preliminary documents, she looked toward Brian.
"Mr. Carter."
"You have petitioned this court for joint physical custody of your daughter."
"Is that correct?"
"Yes, Your Honor."
"And do you believe that arrangement serves Lily's best interests?"
Brian swallowed.
"Yes."
Judge Ellis nodded.
"Very well."
"Mrs. Carter?"
Rebecca stood.
"My client believes supervised visitation is appropriate at this time."
Donna immediately scoffed.
Judge Ellis looked up sharply.
"Mrs. Carter Senior."
"One more interruption and you will be removed."
Donna forced herself to remain silent.
Rebecca approached the witness stand first.
"Your Honor, we'd like to begin with hospital records."
The clerk handed copies to the judge.
Rebecca spoke calmly.
"These records establish that Lily Carter arrived at Westbrook Children's Medical Center with a documented temperature of one hundred and four degrees Fahrenheit."
Judge Ellis examined the chart.
"Time of admission?"
"7:46 p.m."
Rebecca nodded.
"We also call Dr. Rachel Morrison."
Moments later, the pediatrician took the witness stand.
After taking the oath, she answered Rebecca's questions clearly.
"When Lily arrived, what was her condition?"
"She had a dangerously high fever and signs of dehydration."
"Was treatment urgent?"
"Yes."
"What would likely have happened if treatment had been delayed?"
Dr. Morrison paused before answering.
"In my professional opinion..."
"...another thirty to forty minutes could have resulted in a febrile seizure."
The courtroom became noticeably quieter.
Rebecca continued.
"Would delaying treatment have placed the child at unnecessary risk?"
"Yes."
"There is no doubt about that."
Brian lowered his head.
Donna crossed her arms.
Rebecca walked toward the evidence table.
"Your Honor."
"The next exhibit establishes why treatment was delayed."
She connected her laptop to the courtroom monitor.
Brian closed his eyes.
He already knew what was coming.
Judge Ellis nodded.
"Proceed."
The recording began.
Lily leaned weakly against Megan.
The thermometer flashed.
104°F.
Megan showed it to Donna.
Donna rolled her eyes.
The recording continued.
Megan turned toward Brian.
The courtroom listened as his own voice filled the speakers.
"Can it wait another hour?"
The words echoed painfully.
Brian's attorney quietly lowered his pen.
No one moved.
No one interrupted.
The recording continued until—
The slap.
Lily screamed.
Megan shielded her daughter.
The judge watched every second without expression.
When the video ended, she folded her hands.
She didn't immediately speak.
Instead, she turned toward Brian.
"Mr. Carter."
"Do you dispute the authenticity of this recording?"
Brian slowly stood.
"No, Your Honor."
"Did you strike your wife while she was holding your daughter?"
"Yes."
"Were you aware your daughter had a documented temperature of one hundred and four degrees?"
"...Yes."
"Did you ask your wife to delay medical treatment?"
Brian's voice nearly disappeared.
"Yes."
The silence that followed felt heavier than any argument.
Brian's attorney stood.
"Your Honor."
"My client accepts responsibility."
"He has voluntarily enrolled in anger-management counseling."
"He has begun individual therapy."
"He deeply regrets his actions."
Judge Ellis nodded.
"I've reviewed those records."
Then she looked directly at Brian.
"Mr. Carter."
"I believe you regret what happened."
"But regret alone is not the legal standard."
"The court must determine whether your judgment protected your child."
Brian couldn't answer.
Because he already knew it hadn't.
Donna finally rose from her chair.
"Your Honor."
"I need to explain—"
Judge Ellis interrupted.
"Were you called as a witness?"
"No."
"Then sit down."
Donna ignored the instruction.
"Megan exaggerated Lily's condition."
Rebecca calmly lifted another folder.
"We anticipated that statement."
She handed a document to the bailiff.
"This is the digital timestamp from the home thermometer."
Another document followed.
"This is the emergency dispatch timeline."
Then another.
"This is hospital triage."
Every time matched.
Every minute accounted for.
The fever had been real.
The danger had been real.
The delay had been real.
Donna slowly sat back down.
For once...
She had nothing left to argue.
After a short recess, Emily took the witness stand.
"Miss Carter."
Rebecca began.
"How are you related to Mr. Carter?"
"He's my cousin."
"Do you love your family?"
Emily smiled sadly.
"I do."
"Why testify against them?"
Emily looked toward Brian.
Then toward Megan.
Finally, she answered.
"I'm not testifying against my family."
"I'm testifying for the truth."
The courtroom remained silent.
Rebecca continued.
"When you recorded the incident..."
"...did anyone ask you to do so?"
"No."
"Did Megan know you were recording?"
"No."
"Did you edit the video?"
"No."
"Why keep it?"
Emily's eyes filled with tears.
"Because I was afraid everyone would pretend it never happened."
Her words hung in the courtroom.
No one questioned her sincerity.
The final witness surprised everyone.
Thomas Carter.
Brian's father.
Rebecca hadn't listed him in advance.
Judge Ellis allowed the testimony.
Thomas walked slowly to the stand.
He looked directly at his son before speaking.
"I failed him."
Brian looked up.
"Dad..."
Thomas shook his head gently.
"I taught my son to keep the peace."
"I should have taught him to protect the people he loved."
Brian covered his face with one hand.
His shoulders trembled.
For the first time since the hearing began...
He cried.
Not loudly.
Not dramatically.
Quiet tears of shame.
Judge Ellis recessed for one hour before delivering her temporary ruling.
Everyone returned to the courtroom in complete silence.
She opened the file.
"This court recognizes that Mr. Carter has acknowledged responsibility and has begun seeking treatment."
Brian looked up hopefully.
Then she continued.
"However..."
"The evidence demonstrates that Mr. Carter knowingly delayed necessary medical care for his child."
She cited the hospital records.
The video.
The testimony.
"The court further finds that the child has exhibited signs of emotional trauma associated with loud male voices following the incident."
Megan instinctively closed her eyes.
Judge Ellis looked directly at Brian.
"Therefore..."
"Temporary sole physical and legal custody is awarded to Mrs. Megan Carter."
Brian's face went pale.
"Mr. Carter shall receive supervised visitation every Saturday for four hours at the Family Visitation Center."
Donna stood abruptly.
"This is outrageous!"
The judge struck her gavel.
"Mrs. Carter Senior."
"You are dismissed from this courtroom."
The bailiff stepped forward.
Donna looked around, expecting Brian to defend her.
He didn't.
He remained seated, staring at the custody order lying before him.
His opportunity to be the father Lily deserved had not disappeared forever.
But today...
He had lost almost every chance to prove he already was.
As Megan stepped outside the courthouse, she found Lily waiting on the front steps.
The little girl smiled and ran into her mother's arms.
"Can we go home now?"

"Yes, sweetheart."
